Different obligations create different eligibility rules

A compliance program can define eligible technologies, locations, vintages, tracking systems, and obligated entities. Voluntary programs have their own standards and customer-claim requirements. A certificate acceptable for one purpose may not satisfy the other. Avoid treating a general national REC price as a universal value across all markets. The relevant state program, voluntary certification standard, and reporting method determine whether a specific instrument fits the intended use.

Prevent double counting of the same attribute

The same renewable attribute cannot simply be counted for a legal obligation and separately claimed as a voluntary purchase beyond that obligation without regard to the applicable rules. EPA’s market principles explain regulatory surplus in voluntary procurement. Ask how certificates are designated and retired, whether they meet compliance obligations, and what claim rights transfer to the business. Preserve registry and retirement evidence. Buying energy from a renewable project does not automatically transfer unused voluntary attributes if those rights were retained or sold elsewhere.

Review the product and public statement together

The contract should identify resource, geography, vintage, quantity, purpose, ownership, replacement, and retirement beneficiary. Verify any certification at the exact product level. A business can make different statements about a utility’s mandated portfolio and its own additional voluntary purchase; avoid merging them into an inflated claim. Scope 2 accounting and consumer marketing also have their own methods and requirements. Qualified review is appropriate where the transaction or public statement is material or the boundary is unclear.

Practical procurement example

A company receives two certificate offers: one described as eligible for a specific state compliance program and one designed for a voluntary certified product. It should first define its objective, then inspect whether the exact offered certificates meet the necessary rules. A higher or lower price alone does not answer that question. The company must also verify retirement and avoid counting the same MWh through multiple products. This example illustrates classification rather than declare either offer suitable without its documents.

Practical review checklist

  • Identify the precise compliance obligation or voluntary objective and its current eligibility criteria.
  • Verify resource, location, vintage, tracking, retirement purpose, beneficiary, and transferred rights.
  • Check regulatory surplus and double counting under applicable program and reporting rules.
  • Keep mandated portfolio information distinct from additional voluntary purchases in public statements.

Questions & answers

Can any REC support a voluntary claim beyond legal requirements?

No. Eligibility, surplus, ownership, and retirement criteria must be checked for the intended program or claim.

Does buying renewable electricity always include unused certificates?

No. The agreement must convey the relevant attributes; project energy and certificates can be sold separately.
